General Disclaimer and Notice of Waiver
Participation in programs administered by Fine Feather Foundation Inc., including affiliated initiatives, may involve educational activities, athletics, physical recreation, arts programming, workshops, mentoring, transportation, and off site field trips. Participation involves inherent risks, including but not limited to bodily injury, illness, emotional distress, property damage, and transportation related risks.
By enrolling a participant, the parent or legal guardian acknowledges and agrees that participation is voluntary and subject to the terms set forth in the following documents, which are incorporated herein by reference:

• Privacy Policy
To the fullest extent permitted under the laws of the Commonwealth of Pennsylvania, the Assumption of Risk and Release of Liability includes a waiver of claims arising from ordinary negligence. The Release does not waive liability for gross negligence, recklessness, or intentional misconduct to the extent prohibited by law.
I understand that enrollment and participation are conditioned upon acceptance of these terms.
Assumption of Risk, Release of Liability, Indemnification, and Medical Authorization
Acknowledgment of Activities and Risks
Participation in programs administered by Fine Feather Foundation Inc., including but not limited to educational programming, athletics, physical recreation, arts activities, workshops, mentoring, transportation, and off site field trips, involves inherent and foreseeable risks.
Such risks include, but are not limited to:
• Bodily injury
• Illness or exposure to communicable conditions
• Emotional distress
• Property damage or loss
• Accidents during transportation
• Injuries arising from athletic or physical activity
• Injuries occurring on third party premises
• Slips, falls, collisions, or equipment related injuries
These risks may arise from the actions or omissions of participants, other participants, staff, volunteers, contractors, transportation providers, property owners, third parties, or from conditions of facilities or vehicles.
Assumption of Risk
By enrolling a participant in Foundation programs, the parent or legal guardian knowingly and voluntarily assumes all risks, both known and unknown, inherent or otherwise, arising out of or related to participation in any Foundation program or activity, including transportation and off site events.
Release and Waiver of Liability
To the fullest extent permitted under the laws of the Commonwealth of Pennsylvania, the parent or legal guardian releases, waives, and discharges Fine Feather Foundation Inc., its affiliated programs, directors, officers, employees, agents, contractors, volunteers, transportation providers, facility partners, sponsors, and representatives from any and all claims, demands, causes of action, damages, losses, costs, or liabilities arising out of or relating to participation in Foundation programs, including claims based upon ordinary negligence.
This release is intended to be as broad and inclusive as permitted by Pennsylvania law.
This release does not apply to conduct that constitutes gross negligence, recklessness, or intentional misconduct to the extent such limitation is prohibited by law.
Transportation and Off Site Activities
Transportation may be provided by Foundation staff, volunteers, contracted drivers, or third party providers. Participation may include travel and activities conducted on property not owned or controlled by the Foundation.
The parent or legal guardian expressly assumes all risks associated with transportation and off site activities and releases the Foundation and related parties from liability arising out of such activities, including claims based on ordinary negligence.
Medical Authorization
In the event of illness or injury, the parent or legal guardian authorizes Fine Feather Foundation Inc. to obtain emergency medical treatment for the participant if the parent or guardian cannot be reached.
Reasonable efforts will be made to contact the parent or guardian prior to treatment when feasible.
The parent or guardian agrees to be financially responsible for any medical expenses incurred as a result of such treatment.
Indemnification
The parent or legal guardian agrees to indemnify and hold harmless Fine Feather Foundation Inc. from and against any claims, damages, liabilities, or expenses, including reasonable legal fees, arising from:
• The participant’s intentional or unlawful conduct
• The participant’s material violation of program rules
• Claims brought on behalf of the participant that contradict this Release
Limitation of Damages
To the fullest extent permitted by law, any recovery against Fine Feather Foundation Inc. shall be limited to direct damages only. Claims for consequential, incidental, punitive, or exemplary damages arising out of participation in Foundation programs are waived.
Governing Law and Venue
This Release shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania.
Any legal action arising from participation in Foundation programs shall be brought in a court of competent jurisdiction located within Pennsylvania.
Severability
If any provision of this Release is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Program Terms and Conditions (Effective January 2026)
Acceptance of Terms
By enrolling a participant in any program, activity, workshop, event, or service administered by Fine Feather Foundation Inc., including its affiliated initiatives, the parent or legal guardian agrees to these Program Terms and Conditions. Participation is conditioned upon compliance with these Terms.
Eligibility and Enrollment
Participants must meet the eligibility requirements established for each program. Fine Feather Foundation Inc. reserves the right to verify eligibility, including age, residency, or school enrollment where applicable. Submission of enrollment materials does not guarantee acceptance into a program.
Code of Conduct
Participants are expected to conduct themselves in a respectful, lawful, and safe manner at all times.
Prohibited conduct includes, but is not limited to:
• Physical aggression or threats
• Harassment or bullying
• Destruction of property
• Possession of prohibited substances or weapons
• Disruptive behavior that interferes with program operations
The Foundation reserves the right to suspend or remove a participant for conduct that compromises safety, program integrity, or mission alignment.
Supervision and Program Hours
Supervision is provided only during designated program hours and within designated program spaces or activity locations.
The Foundation is not responsible for participants:
• Prior to official program start time
• After designated dismissal time
• Outside approved program locations
• When a participant leaves program premises without authorization
Parents or guardians remain responsible for transportation to and from programs unless otherwise stated in writing.
Open Participation Programs
Certain programs may operate under an open participation structure. Participants may be permitted to enter or leave at designated times consistent with program guidelines.
The Foundation does not assume responsibility for participants once they voluntarily leave the program premises during approved release times.
Health and Safety
Parents or guardians must disclose relevant medical conditions, allergies, or special needs that may affect participation. The Foundation reserves the right to deny or modify participation if a health or safety risk cannot be reasonably accommodated. Participants who are ill may be sent home at the discretion of program staff.
Photography and Media
Participation in Foundation programs involve photography, video recording, and documentation for organizational purposes. Media usage is governed by the separate Release and Media Authorization and Privacy Policy.
Data Collection and Privacy
Participant and parent information may be collected for administrative, evaluation, reporting, and compliance purposes.
All information practices are governed by the Fine Feather Foundation Inc. Privacy Policy, effective January 2026, which is incorporated herein by reference.
Program Modifications
Fine Feather Foundation Inc. reserves the right to modify program schedules, locations, instructors, curriculum, or operational procedures as necessary.
Programs may be suspended or canceled due to safety concerns, funding limitations, facility issues, weather conditions, or other unforeseen circumstances.
Withdrawal
Parents or guardians are encouraged to provide advance notice if withdrawing a participant from a program. Specific programs may impose additional withdrawal policies where applicable.
Attendance Requirements
Regular attendance is required for continued participation in Foundation programs.
A participant who incurs three or more unexcused absences may be subject to removal from the program at the discretion of Fine Feather Foundation Inc.
An unexcused absence is defined as a failure to attend a scheduled session without prior notice or documented justification deemed acceptable by program administration.
If a participant is removed due to excessive unexcused absences, the participant’s spot may be offered to an individual on the program waitlist. Re enrollment after removal is not guaranteed and may require a new application.
Limitation of Organizational Authority
Nothing in these Terms shall be interpreted to waive rights or obligations that cannot be waived under applicable law.
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Lehigh County of the Commonwealth of Pennsylvania regardless of program location.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Acknowledgment
By enrolling the participant, the parent or legal guardian acknowledges that they have read, understood, and agree to these Program Terms and Conditions.
Privacy Policy (Effective January 2026)
Purpose and Scope
Fine Feather Foundation Inc., including its affiliated programs and initiatives, is committed to protecting the privacy and confidentiality of the individuals and families we serve. This Privacy Policy describes how we collect, use, disclose, and safeguard personal information obtained through our programs, applications, surveys, events, website, and related activities.
This Policy applies to all participants, parents or guardians, volunteers, staff members, donors, and website users interacting with Fine Feather Foundation Inc. and its affiliated programs.

Media and Publicity
By accepting the terms and participating in Fine Feather Foundation Inc. programs, participants and parents or guardians grant consent for the organization to use participant names, photographs, video recordings, artwork, testimonials, and related media for program promotion, reporting, fundraising, community engagement, and related nonprofit purposes, unless otherwise prohibited by applicable law.
Participant and Parent Rights
Parents or guardians may request to review, correct, or update personal information maintained about their minor child, subject to legal and programmatic limitations.
Requests should be directed in writing to the Program Director at Fine Feather Foundation.
Third-Party Platforms
Programs may utilize online tools, survey platforms, communication systems, or educational software. These platforms may collect data subject to their own privacy policies. We select vendors that implement reasonable data security practices, but we are not responsible for the independent policies of third-party providers.
Changes to This Policy
Fine Feather Foundation Inc. reserves the right to update this Privacy Policy as necessary to reflect operational, legal, or funding changes. Updated versions will be posted with a revised effective date.
